Advertising guidance from regulators prohibits companies from using inflated original prices in their advertisements to make it look like they’re offering big value at a steep discount. Be wary of advertising that offers a “discounted” price that is actually the perpetual price of an object. We have concerns Nectar is doing just that. They offer their mattress at $899 as a “limited offer.” But our review calls this into question. It seems this has been the price of the Nectar mattress for at least a year. The only thing that appears to change is the holiday or other reason Nectar has given for the continuous “discount.” This is why we use $899 as Nectar’s regular sales price. At Tuft & Needle, we believe in honest pricing, and know a permanent “sale” is no bargain.
Nectar offers two “free” pillows with purchase that it claims have a $150 value. Offering “free” merchandise with purchase is a common form of bargain advertising, and it’s easy to spot. However, advertising “free” merchandise can be misleading when there is nothing special or meaningful about the offer, or when the “free” price isn’t based on the regular price for the items. In this case, our review of Nectar’s marketing indicates that Nectar has been running its “2 free pillows” offer for at least a year; throughout this time, Nectar’s “free” pillows have not actually appeared to be actively sold on Nectar’s website. According to the FTC’s complaint, Nectar Brand LLC claimed in promotional materials that its mattresses were “Designed and Assembled in USA,” but in fact the mattresses are wholly imported from China, with no assembly taking place in the United States.
Under the terms of the proposed order, Nectar is prohibited from making unqualified U.S.-origin claims for mattresses or other products or services unless it can show that the products’ final assembly or processing—and all significant processing—take place in the United States and that all or virtually all ingredients or components of the product are made and sourced in the United States.
